The provisions of the intelligent agent in Islamic jurisprudence A comparative jurisprudential study

Abstract

AI agents are rational agents that make rational decisions based on their perceptions and data to achieve optimal performance and outcomes. An AI agent senses its environment through physical or software interfaces and analyzes the collected data to predict the best outcomes that support pre-defined goals.
The intelligent agent also uses the results to formulate the next action to take. In many areas, the intelligent agent joins the work on behalf of humans and completes it perfectly, so there are countless examples of intelligent agents, the most important of which is their use in the field of commerce.
In this research, I followed the inductive, deductive, descriptive and comparative approach, where I followed the statements of legal experts and information technology experts in defining the smart agent, and the difference between him and the ordinary agent, and I addressed the historical development of the emergence of the smart agent, then I followed the descriptive approach to show the forms of contracting with the smart agent and his conclusion of smart contracts and the effect of his violation of his client, then I derived the legal ruling for each image after adapting it and clarifying the opinions of the owners of the schools of thought and their evidence, analyzing and criticizing them, and comparing them with deriving the chosen opinion without bias towards a particular opinion.
The study concluded that the contract concluded through intelligent agents is valid, enforceable and produces all its legal effects between its two parties
