Abstract:
In fact, in legislative and legal terms, people enjoy full freedom to be subject to any contractual obligations, but when people accept to enter into certain commitments between each other, it will be subject to them for the duration of its entry into force, as long as the place of this obligation is not incompatible with public morals. In practice, however, the final contracting phase between people may be preceded by a preliminary stage leading in an investigative or otherwise to the final stage.
Consequently, the stage preceding the conclusion of the "final contract" is considered one of the most important and serious, stages of the latter because of its determination of the most prominent and most of the rights and obligations of the "parties to the contract". It depends on multiple legal problems. Promising to sell the property of others on his behalf is more acute problem which this research will discuss.
Before adjudicating the dispute before it, the court must adjust the relationship between the opposing parties as agreed upon and verify the general proxy or promise of sale as each one of them has its own terms and conditions and implications. Besides, the promise of sale may be depended on a clause whether that clause is the accepting the tender or terminating a contract previously which confirms that the sale of third parties' property may be promised in the event that ownership will be given to the party who would promise.
