The Presence of Witnesses in the Marriage Contract in Islamic Jurisprudence

Abstract

Marriage is one of the blessings that God has bestowed upon people, and one of God Almighty’s laws in this universe to achieve the great message for which God created man, which is the caliphate of the earth. The contract must be based on a sound and solid foundation, and in order for the contract to be valid, it must meet conditions, and among these conditions is the presence of witnesses, the marriage contract. With the progress of change and rapid development in people’s lives, many issues have arisen in the marriage book. (The ruling on the presence of witnesses in the marriage contract) In Islamic jurisprudence, I ask God Almighty to make it pure for his honorable face.
The research included an introduction, four demands, and a conclusion:
As for the first requirement, it sheds light on the definition of the testimony, linguistically and idiomatically, its ruling, and its conditions. As for the second requirement: it was discussed about the definition of marriage, its ruling, and its conditions. The third requirement: It was talked about the issue of the presence of witnesses in the marriage contract. Is it a condition in its holding or not? The wisdom of the legitimacy of attestation.
As for the fourth requirement: it was in making contracts through electronic means.
And the conclusion, which included the most important results of the research.
