The Eligibility of a Discerning Person to Become a Mahram While Traveling

Abstract

The issue of a mahram (guardian) for a woman traveling is a sensitive one that is often re-raised, either theoretically or practically. The reason for this re-raising issue is the presence of a number of contemporary challenges, including women's frequent need to travel and move around due to certain requirements that have become essential in society and that cannot be fully met by the husband or father alone. Also, there is the tremendous development witnessed by various types and forms of transportation and communication.
This study (The Eligibility of a Distinguished Person to Be a Mahram for Travel) aims to uncover one of the proposed solutions when a woman does not have a Mahram, which is for a discerning child to accompany the woman on her travel, and to determine the validity of his legal eligibility for this.
The study reached a number of results, including: that the discriminating person is able to distinguish between good and evil, but he is unable to bring good and prevent evil by natural force, and Jurists differed about my familyteFor the mahram sayings:The Malikis held that he is eligible, the Hanbalis held that he is not eligible, and the majority held that he is not eligible until he approaches puberty.ِNْHis boat became worthy of theَHaramiyahAnd thiswhoَIt is more likely from the sayings of the scholars becauseّThe legal rule: Whatever is close to something is given.َI HAhow muchَH
