Issues of "The Book of Principles of Jurisprudence" in "Nithar al-Jawhar" by al-Bahlani and "Jawhar al-Nizam" by al-Salmi: Presentation, Arrangement, and Comparison

Abstract

This study analyzes the Usūlī introduction in Nithār al-Jawhar by Abū Muslim al-Bahlānī, comparing it with Jawhar al-Niẓām by Imām al-Sālmī. It examines the nature of the Usūlī content in both works, Abū Muslim’s contributions, and the methodological differences between them, while assessing al-Sālmī’s influence on Abū Muslim. Using a comparative analytical approach, the study explores the development of Usūlī thought in the Ibāḍī school and highlights Abū Muslim’s engagement with al-Sālmī’s work.
Findings reveal that Abū Muslim primarily reformulated the Kitāb Uṣūl al-Fiqh from Jawhar al-Niẓām, maintaining its content with minimal additions, while addressing some topics absent in al-Sālmī’s work. Consequently, attributing Usūlī views to Abū Muslim requires caution unless explicitly stated and absent from the original text.
The study recommends further research on Ibāḍī Usūlī scholarship and the influence of Omani juristic works. It also underscores the need for precise evaluation of postgraduate research, as many texts are adaptations rather than independent contributions, which may lead to misinterpretation of their scholarly significance.
