Re- discount Rate An analytical, original, jurisprudential study

Abstract

This study aims to determine re-discount rate and clarify its legal origin according the Chapters of Fiqh It suits him . This study was divided two sections: The first section was divided two requirements. first requirement the re-discount rate, and emphasis of the place. The second requirement deals the financial value time. The second section dealt the Fiqh derivation the re-discount rate. divided four requirements Depending on the necessity of research, According to the contracts concluded, by mentioning the sayings the faqihs the issue, Presenting and discussing the evidence, the first requirement dealt the derivation on the basis a sale, the sale here is the sale of the debt to someone other than him, not the selling commercial paper. the second requirement dealt derivation the re-discount rate on the basis of reconciliation. third requirement dealt derivation on the basis of a paid agency, the fourth requirement dealt the derivation the re-discount rate on the basis of the loan . To achieve the goals the research, the methodology used in the study is the inductive methodology what the faqihs wrot , and the analytical deductive methodology. The study concluded results of which are: The re-turn rate can be derived on the basis selling the debt to others, the bank takes from debtor the money he paid to his, without increase, provided the creditor pays the bank’s fees and administrative operations. the creditor has waived and dropped part of the debt for the debtor’s account not for the bank’s account.
