Abstract
The research aims to explain to the judge that he refrains from expressing his opinion, or orientation, in a case before any party. Otherwise, the judge becomes unfit to consider the case if he violates this prohibition. The necessity of equality between litigants before the court, with a clarification of the concept of the judge's impartiality in evidentiary systems. Its importance lies in the fact that the rule in the judiciary and judges is impartial and objective with all citizens, and therefore they are prevented from expressing an opinion on political actions in any way, and in any case, the problem of research lies in whether the impartiality of the judge requires that it be negative in the course of litigation, or that it does not contradict his behavior Positive in guiding the course of litigation to achieve justice? In this research, the historical documentary approach was followed by referring to the references and related sources, then the descriptive approach, the analysis, by explaining the material accurately. Then I reached several results, including the principle in the judiciary and judges, impartiality and objectivity with all citizens, and from the recommendations the judge must adhere to impartiality, and this is useful, and is consistent with the nature of the work of the judges, and the separation of powers
