Barriers to civil liability for transmitting and spreading epidemics in the Saudi law as applied to (Covid 19)

Abstract

The research dealt with the topic of contraindications of civil liability for the transmission and spread of epidemics in the Saudi system in application to (covid-19), through an introduction and a preliminary requirement in addition to two separate researches, the preliminary requirement dealt with the definition of search terms, the first research came under the name of types of civil liability and its pillars, through two demands, the second research. While the research problem was to demonstrate the adequacy of the rules of the Saudi system to ensure compensation for damage caused by the transmission and spread of coronavirus infection in accordance with civil liability. The aim of the research was to clarify the provisions regulating civil liability in relation to the transmission and dissemination of epidemics in particular, in addition to the indication of the contraindications of civil liability in relation to the transmission and dissemination of epidemics in the Saudi system. One of the most important results was to show the contraindications of civil liability for the transmission and spread of covid-19 by the absence of error, in addition to the lack of a causal relationship between error and damage, in addition to the most important recommendations were the legalization of a specific and explicit system related to epidemiology, ways to prevent and criminalize it, and how to deal with pandemics by the state, citizens and residents.
