Abstract

The examination of damages claims in the 1437 A.H. Corporate System constitutes great necessity at present time with many companies and the resulting mistakes caused by partners that the the person responsible for compensation, the person who initiates such proceedings and the competent authority for their consideration.
In addition to identifying the legitimate rooting aspect of them with the use of judicial applications in compensation for such corporate system and the claim for damages to the corporate system, Knowledge of judicial applications in compensation for company and knowledge of judicial applications in judicial applications in compensation for liquidation or bankruptcy of companies and used investigative descriptive research by tracking the facts and parts of the subject in the texts of the articles of the corporate system that relate to the subject of the compensation claim and research in its sources in the Saudi judiciary.
The research has reached the following findings:
1- The Court Cases decided by commercial courts as commercial courts have the right to rule on compensation cases in cases arising out of companies or merchants. Compensation cases for damages in commercial courts is brought against those who have acquired merchant status, which we find that the regulator has two prerequisites for granting and acquiring merchant status:
Assuming commercial business.
Professionalism of doing such business.
