The fall of the islamic punishments (Hudud) by the prescription "a comparative study"

Abstract

This study has been divided into four sections. In the first topic, it showed the concept of prescription and the concept of limits. The second topic: the effect of prescription on filing a lawsuit in crimes that require an end, and divided it into two demands. The second: the effect of the statute of limitations on the confession of the crime that requires an end. As for the third topic: the effect of prescription on the marginal penalty, and divided it into two demands: the first: the effect of prescription on the limitation penalty fixed for recognition, and the second requirement: the effect of prescription on the marginal penalty fixed by testimony. As for the fourth topic: the limitation period affecting the fall of the punishments according to the Hanafis, I divided it into two demands: the first: the limitation period in the limits of adultery and theft according to the Hanafis, and the second requirement: the limitation period in the limit of drinking alcohol at the Hanafis, and in the end I came to a conclusion that included the most important results .
