Abstract

Research entitled: "Pardon in marital rights", and the research has been organized in four topics: The first: in defining pardon, related terms and terms, and the second: in defining rights, and their departments by considering financial and the pardon of them, and the third: in pardoning financial rights between the spouses And the fourth: Pardon in non-financial rights between the spouses, and the following shows: * The rights-in the general and non-financial form of the couple or for one of them, have been delegated to the street to pardon them; Because in it in order to preserve the family in which the offspring is preserved, which is one of the necessary purposes of Islam; In addition to the tolerance, facilitation, and curvature of the scorpion. * That the right to be attached to another right, it is not permissible to pardon it from one side, such as pardoning the right of competence to marriage, because it is attached to the right of the saints, and that the wife is dropped her right to oath and childbearing; To attach them to the right of the husband, and it is not correct to pardon these rights except with the approval of those who are attached to the right. * That the wife can forgive her husband, from his past alimony, and it is not correct to forgive the alimony for what is received from time; Because alimony is required little by little, as it is to drop it means dropping a right before it is obligatory. * The inheritance is a right for the wife after the death of her husband, and she has to act in it as the right of rights, so she has to forgive or fulfill it, and it is not valid to require him to drop it in the contract; Because the inheritance is not perfect except after the death of the inheritance, and it is a right that has not yet been answered, and the rule: that the truth does not fall before it is obligatory and proven. * If the wife is invaded, then the husband may preach, abandon her, and strike her, but pardon is better than fulfilling his right to discipline her. 9
