Percentage of what is applied in our reality of Islamic law

Abstract

The research dealt with this issue in two chapters; The first chapter is entitled: Misconceptions about Sharia that must be corrected. The research dealt with successive demands titles that show the pillars of the subject, such as: What is the Sharia that we want to apply, then I edited the term Sharia, and referred to the word positive law, what it has and what it is against, then how to judge a society that it is a Muslim society? And he discussed the issue of the age of suspicion, and is our age the age of doubt? And what is the consequence of that? The second chapter is entitled: Sharia applied in practice. I carefully monitored in it what is applied on the ground from the four quarters of jurisprudence, and I made for each quarter of jurisprudence a requirement that belongs to it, worship first, transactions second, marriage third, and I ended with a quarter of felonies. Changing this method to another method to meet the limit? Is the use of the sword in retribution specific? Or can it be replaced? Does the guardian have the sole authority to fulfill the qisas, or does he have to empower the rightful owner from the culprit? Then the research dealt with the final result of what is applied on the ground of practical Sharia provisions, then we discussed this result to show how close or far from the truth, then the conclusion and recommendations.
