Feudalism and its impact on real estate ownership - a jurisprudential study compared to the Saudi system

Abstract

Islam has permitted private ownership, and agricultural ownership is a form of ownership, whether it is in the form of ownership of a piece of land, or the exploitation of its benefits, provided that the owner or exploiter of the land does not violate a rule of Islam, and that no individual or group is harmed by this behavior. Iqta’ is a method used by the state for the purpose of increasing the exploitation of lands, and it is one of the ways to invest the lands that were gifted by God to his creation, and one of the blessings that necessitate thanks for exploiting it and producing its crops to feed people and meet their sufficiency. Owning land and real estate, whether by purchase, exchange, gift, or by reviving fallow land, and these are arguments extracted from the courts to prove ownership. I made this research in three sections, the first topic on the concept of feudalism and its ruling and the distinction between it and related words, the second topic on the types of feudalism, and the third topic on the effects of feudalism in Islamic jurisprudence and the Saudi system, and finally the conclusion.
